Conditions of sale in the e-shop
1. Validity of conditions of sale
1.1. The conditions of sale apply to the purchase of goods and services between the buyer and the company Puhastusimport OÜ (hereinafter Puhastusimport) from the e-shop of puhastusimport.ee.
1.2. In addition to these conditions, the legal relations arising from the purchase of products from the e-shop of PUHASTUSIMPORT are regulated by the Law of Obligations Act, the Consumer Protection Act, and other legislation in force in the Republic of Estonia.
1.3. PUHASTUSIMPORT reserves the right to make changes to the conditions of sale. These changes are reflected on the website PUHASTUSIMPORT.ee.
1.4. The pictures of the products in the e-shop are for illustrative purposes only and may differ from the actual products.
1.5. Unintentional errors may occur in the description of products in the e-shop. We recommend checking the data on the manufacturers’ websites.
1.6. PUHASTUSIMPORT has the right to withdraw from the sales contract concluded via the e-shop without sanctions and not to deliver the ordered goods or provide the service in the following cases:
- the goods are out of stock;
- the price or features of the goods have been displayed incorrectly in the e-shop due to a system error;
- the buyer does not meet the conditions established by PUHASTUSIMPORT.ee.
If PUHASTUSIMPORT is unable to fulfil the order, PUHASTUSIMPORT will contact the buyer and refund the amount paid when the buyer has paid in advance for the goods.
2.1. All prices in the PUHASTUSIMPORT.ee e-shop include 20% VAT.
2.2. The transport price is added to the price in accordance with the delivery method chosen by the buyer.
2.3. The prices are valid from the time the order is placed until the expiration date of the completed order (1 day after the order is placed).
3. Placing an order
3.1. Add the desired item to the cart.
3.2. To view the contents of the shopping cart, select ‘Shopping Cart’ (Ostukorv) in the upper right corner of the web page.
3.3. To place an order, select the delivery method that suits you.
3.4. After selecting the delivery method, fill in the required fields with your data.
3.5. After entering your information, select the payment method that suits you.
3.6. To confirm the order, check the box ‘Yes, I agree to the terms’ (Jah, olen nõus tingimustega) and then select ‘Next’ (Edasi).
3.7. Orders placed in the PUHASTUSIMPORT.ee e-shop are processed on working days Mon–Fri 8 a.m. to 5 p.m. If the order is submitted on Friday after 2 p.m., the order will be placed the following Monday.
4. Entry into force of the sales contract
4.1. With the sales contract goods, PUHASTUSIMPORT undertakes to transfer to the buyer the existing goods, goods that are being manufactured, or goods that PUHASTUSIMPORT will acquire in the future and to enable the transfer of ownership to the buyer, while the buyer undertakes to pay PUHASTUSIMPORT the amount indicated on the invoice submitted for the goods and to accept the goods.
4.2. Orders that have not been paid for will be canceled 7 days after the order is placed.
4.3. The sales contract enters into force after the payment made by the buyer to the bank account of PUHASTUSIMPORT.
5.1. After the entry into force of the sales contract, the goods can be received in three ways:
5.1.1. The courier company will deliver the goods to you at the address indicated on the order;
5.1.2. The goods will be sent to you to the parcel machine of Omniva marked on the order;
5.1.3. It is possible to pick up the goods at the store indicated on the order (minimum order value 10 euros).
5.2. The delivery terms indicated on the e-shop website are valid from the moment the order amount is received in the e-shop’s bank account.
5.3. In order to enable deliver without delay, true and valid data must be provided when placing an order.
5.4. PUHASTUSIMPORT is not responsible for the delay in delivery of the goods if the goods have been handed over to the logistics partners on time, but the delay in delivery is due to circumstances that could not be affected or foreseen by PUHASTUSIMPORT.
6. Right of return
6.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. The right of withdrawal applies only to private consumers, it does not apply to legal entities.
6.2. In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics, and functioning of the goods in the manner permitted for testing the goods in a physical store. Goods cannot be returned if the consumer has opened the wrapper. In addition, goods cannot be returned if they are items with a sealed package that are not suitable to return for health or hygiene reasons, if the package is opened after delivery (e.g. cleaning products, filters, consumables, hygiene products, etc.).
6.3. The returned product must be complete (include the product packaging and all items included in the product packaging – cables, additional nozzles, etc.). In the case of a promotional product that was purchased with a gift or other product, the entire set (i.e. all products) must be returned.
6.4. If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods or have signs of use or wear, PUHASTUSIMPORT has the right to reduce the refundable fee in accordance with the decrease in the value of the goods.
6.5. In order to return the goods, a withdrawal application (free form) must be submitted and sent to the e-mail address no later than within 14 days of receipt of the goods.
6.6. The buyer must return the goods within 14 days of submitting the application or provide proof that they have handed over the goods to the logistics company within the aforementioned period.
6.7. The costs of returning the goods will be borne by the buyer, unless the reason for the return is the fact that the item to be returned does not correspond to what was ordered (e.g. the wrong product).
6.8. PUHASTUSIMPORT will, upon receipt of the returned goods, return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer under the contract. Refunds may be refused until the item which is the subject of the contract has been returned or until the buyer has provided proof that they have returned the item, whichever is the earlier.
6.9. If the buyer has expressly chosen a method of delivery other than the cheapest normal delivery method offered by PUHASTUSIMPORT, the consumer will not have to be reimbursed for a cost that exceeds the cost associated with the normal delivery method.
6.10. The buyer bears the direct costs (including postage and delivery costs) related to the return of the goods delivered to them.
6.11. PUHASTUSIMPORT is not responsible for defects that have occurred after the delivery of the goods to the buyer.
7. Force majeure
7.1. PUHASTUSIMPORT is not liable for damages caused to the customer or delay in delivery of the goods if the damage or delay in delivery of the goods is due to circumstances which PUHASTUSIMPORT could not have affected or foreseen.
8. Processing of personal data
8.1. By entering data in the e-shop and with the corresponding confirmation, the buyer grants the right to collect and process the buyer’s personal data (name, contact telephone number, parcel delivery and / or home address, e-mail address), and to forward their personal data to logistics partners for delivery.
8.2. PUHASTUSIMPORT has the right to use the buyer’s contact information to send advertising and other information to the buyer.
8.3. The buyer has the right to prohibit the collection and use of their personal data at any time, unless it is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
8.4. When paying for purchases with encrypted data communication with banks, the buyer ensures the security of personal bank IDs and there is no access to them in the e-shop.
9. Procedure for submitting claims
9.1. PUHASTUSIMPORT is responsible for non-compliance or defects of the goods sold to the buyer which become apparent within two years from the delivery of the goods to the buyer. We allow legal entities a 3-month claim period.
9.2. In the event of a defect, the buyer has the right to apply to PUHASTUSIMPORT within two months at the latest, submitting an invoice on the basis of which the purchase of the goods was paid for. Notice of non-conformity of the goods must be sent to PUHASTUSIMPORT’s e-mail address firstname.lastname@example.org or by calling +372 651 9080. If the buyer does not notify the non-conformity of the goods within the term provided for in this clause, PUHASTUSIMPORT will be released from liability for the non-conformity of the goods.
9.3. In case of defects, please stop using the goods.
9.4. PUHASTUSIMPORT is responsible for non-conformity of the goods and defects that appear within 2 years from the delivery of the goods to the user as follows:
- during the first six months from the time of delivery of the goods, it is presumed that the non-conformity of the goods already existed at the time of delivery of the goods, i.e. the obligation of proving the conformity of the goods lies with PUHASTUSIMPORT;
- six months after the delivery of the goods, the obligation of proving the non-conformity of the goods lies with the buyer.
9.5. Repair or replacement of defective goods will be agreed between PUHASTUSIMPORT and the buyer.
9.6. PUHASTUSIMPORT is not liable for any defects in the goods caused by the fault of the buyer as a result of improper storage or use of the goods,
9.7. In case of non-compliance or defects of the goods, please send a complaint to the e-mail address email@example.com, stating the name of the orderer, contact telephone number, order number, and a precise description of the non-conformity or defect of the goods.
9.8. A complaint regarding the discovery of non-conformity or defects of the goods must be submitted within two months from the discovery of the non-conformity of the goods.
9.9. All claims will be reviewed and the buyer will be contacted as soon as possible, but no later than within 14 days of receipt of the claim.
9.10. The buyer has the right to demand a reduction of the purchase price from PUHASTUSIMPORT or termination of the contract and to recover the money for the goods if PUHASTUSIMPORT cannot repair or replace the goods or the repair or replacement of the goods fails.
10. The buyer’s right to turn to the Consumer Complaints Commission
10.1. If PUHASTUSIMPORT has refused to resolve the buyer’s complaint or the buyer does not agree with the solution offered by PUHASTUSIMPORT and finds that their rights or interests have been violated, the buyer may file a complaint with the Consumer Complaints Committee through the Consumer Protection Board. The buyer may lodge a complaint themselves or through a representative. The data of the Consumer Protection Commission is provided on the website of the Consumer Protection Board.
